These Terms of Service, Release of Liability and Assumption of Risk ("Agreement") govern your participation in any classes, programs, events, treatments, memberships, workshops, private sessions, or services offered by Soundscape Wellness Inc. ("Soundscape", "we", "our", or "us").

By purchasing a membership, booking an appointment, attending any service, participating in any activity, creating an account, or otherwise using our facilities or website, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.

If you do not agree with these Terms, you must not participate in any Soundscape Wellness services.

PART 1 – ASSUMPTION OF RISK

Participation in wellness, fitness, and therapeutic activities involves inherent risks. While Soundscape Wellness strives to provide a safe, welcoming, and professionally operated environment, injuries and unforeseen events may still occur.

HEALTH ACKNOWLEDGEMENT

You certify that you are physically capable of participating in the services you choose.

PHOTOSENSITIVE WARNING

Some experiences within our immersive studios utilize projection mapping, moving imagery, dynamic lighting, visual effects, lasers, or other audiovisual technology.

Individuals with epilepsy, seizure disorders, photosensitivity, migraines triggered by light, or other neurological conditions should consult their physician before participating.

If you experience dizziness, nausea, visual disturbances, confusion, muscle twitching, or any seizure-like symptoms, you should immediately discontinue participation and notify a staff member.

RELEASE OF LIABILITY

To the fullest extent permitted by applicable law, you release and forever discharge Soundscape Wellness Inc., its owners, directors, officers, employees, contractors, instructors, massage therapists, volunteers, affiliates, landlords, successors, assigns, and representatives from any and all claims, liabilities, damages, losses, costs, or expenses arising out of or related to your participation in any Soundscape Wellness service or your use of our facilities.

PERSONAL RESPONSIBILITY

You agree to exercise reasonable care while participating.

Failure to follow staff instructions may result in removal from classes or services without refund.

PERSONAL PROPERTY

Soundscape Wellness is not responsible for lost, stolen, or damaged personal property brought onto our premises.

Guests are encouraged to leave valuables at home whenever possible.

MEMBERSHIPS, PASSES & BOOKINGS

Memberships, class passes, packages, and appointments are subject to the terms applicable at the time of purchase.

Bookings may require advance payment.

Certain memberships automatically renew unless cancelled according to their terms.

Class schedules, instructors, pricing, services, and facility amenities may change without notice.

We reserve the right to modify or discontinue any service, membership, class, or program at any time.

CANCELLATIONS, RESCHEDULING & REFUNDS

Appointments, classes, and private sessions may be cancelled or rescheduled in accordance with Soundscape Wellness's current cancellation policy.

Unless otherwise stated at the time of booking:

In the event Soundscape Wellness must cancel a class or appointment, participants will be offered a rescheduled booking, account credit, or refund where appropriate.

FITNESS CLASSES

Participants acknowledge that fitness classes, including HIIT, Pilates, Yoga, Boxing, Kickboxing, Zumba, strength training, mobility classes, and other physical activities involve varying levels of exertion.

Soundscape Wellness reserves the right to refuse participation if staff believe continued participation could create an unreasonable risk to the participant or others.

SOUND JOURNEYS, MEDITATION & BREATHWORK

Sound journeys, meditation, breathwork, vibroacoustic sessions, and other wellness experiences may produce emotional, mental, or physical responses that vary from person to person.

These experiences are considered normal responses and should not be interpreted as medical treatment or guaranteed outcomes.

MASSAGE THERAPY & PRIVATE TREATMENTS

Massage therapy and private wellness sessions are intended to promote relaxation, recovery, and general well-being.

Clients agree to disclose any relevant medical conditions, injuries, allergies, pregnancy, recent surgeries, or health concerns before treatment begins.

Massage therapy provided by Registered Massage Therapists is governed by the professional standards applicable to those practitioners.

Soundscape Wellness does not guarantee specific therapeutic or medical results from any treatment.

VIBROACOUSTIC SOUND BED SESSIONS

Participants acknowledge that vibroacoustic therapy combines low-frequency sound, vibration, music, and relaxation techniques.

Individuals with pacemakers, implanted medical devices, uncontrolled epilepsy, certain neurological conditions, or other medical concerns should consult their physician before participating.

Participation is entirely voluntary and at the participant's own risk.

PERSONAL CONDUCT

To maintain a welcoming environment for everyone, participants agree to:

Soundscape Wellness reserves the right to refuse service or remove any participant whose behaviour compromises the safety, comfort, or experience of others.

PERSONAL BELONGINGS

Participants are responsible for safeguarding their own personal belongings.

Lockers or storage areas, where available, are provided solely as a convenience.

Soundscape Wellness assumes no responsibility for lost, stolen, or damaged items.

MEMBERSHIPS & PASSES

Memberships, class packages, promotional offers, and passes are personal to the purchaser and may not be transferred, resold, or shared unless expressly authorized.

Membership fees, pricing, schedules, operating hours, and included services may change from time to time.

Where memberships automatically renew, participants authorize Soundscape Wellness to process recurring payments until cancelled in accordance with the applicable membership terms.

Fraudulent use of memberships or booking privileges may result in immediate suspension or termination without refund.

WEBSITE & ACCOUNT USE

Certain services may require users to create an online account.

PHOTOGRAPHY & MEDIA

From time to time, Soundscape Wellness may photograph or record classes, events, or promotional content.

Reasonable efforts will be made to respect the privacy of participants.

If you do not wish to appear in promotional materials, please notify a staff member before the start of your class or event.

INTELLECTUAL PROPERTY

All logos, branding, class names, written materials, graphics, videos, photography, music, website content, and other intellectual property belonging to Soundscape Wellness remain the exclusive property of Soundscape Wellness Inc. or its licensors.

No content may be copied, reproduced, distributed, modified, or used commercially without prior written permission.

GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the applicable laws of Canada.

Any dispute arising from this Agreement shall be resolved exclusively in the courts of British Columbia unless otherwise required by law.

SEVERABILITY

If any provision of this Agreement is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.

CHANGES TO THESE TERMS

Soundscape Wellness reserves the right to modify these Terms at any time.

Updated versions will be posted on our website and will become effective immediately upon publication unless otherwise stated.

Continued use of our services constitutes acceptance of any revised Terms.

ACCEPTANCE OF THESE TERMS

By booking, purchasing, registering for, or participating in any service offered by Soundscape Wellness Inc., you acknowledge that you have carefully read this Agreement, understand its contents, voluntarily accept its terms, and agree to be legally bound by it.

By proceeding with your booking or participation, you further acknowledge that you are voluntarily assuming all risks associated with participation and releasing Soundscape Wellness Inc. to the fullest extent permitted by applicable law.
